Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of StepSmash, including our mobile applications, websites, forums, community features, subscriptions, games, challenges, and related services (collectively, the “Service”).

The Service is operated by Rescuebase LLC (“Rescuebase,” “StepSmash,” “we,” “us,” or “our”).

By creating an account, accessing the Service, joining a challenge, purchasing a subscription, participating in community features, or otherwise using StepSmash, you agree to these Terms. If you do not agree to these Terms, do not use the Service.

1. What StepSmash Is

StepSmash is a social fitness and activity-based game service. It allows users to connect supported health and activity trackers, participate in activity-based challenges, compare progress with friends, and use social and community features designed to make movement more fun and motivating.

StepSmash is not a medical device, medical service, healthcare provider, fitness coach, or emergency service. The Service is provided for entertainment, social, motivational, and general wellness purposes only.

2. Eligibility

You must be at least 13 years old to use StepSmash. If you are under the age of majority in your jurisdiction, you may use StepSmash only with the permission and supervision of a parent or legal guardian.

By using the Service, you represent and warrant that:

  • You are legally able to agree to these Terms;
  • You will provide accurate and current information when creating or maintaining your account;
  • You will use the Service only for lawful purposes;
  • Your use of the Service does not violate any applicable law, regulation, contract, or third-party right.

We may refuse access to the Service, suspend accounts, or terminate accounts at our discretion if we believe these Terms have been violated or if continued access may create risk for StepSmash, other users, or third parties.

3. Accounts

To use certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us promptly if you believe your account has been accessed without authorization or if your login credentials have been compromised.

You may not:

  • Create an account using false, misleading, or unauthorized information;
  • Impersonate another person or entity;
  • Share your account in a way that allows others to misrepresent themselves;
  • Use another user’s account without permission;
  • Create accounts to evade restrictions, suspensions, bans, or other enforcement actions.

4. Health, Fitness, and Safety Disclaimer

StepSmash encourages movement, but you are solely responsible for your own health, safety, and physical activity choices.

You should consult a qualified medical professional before beginning or changing any exercise, wellness, or activity routine, especially if you have any medical condition, injury, disability, are pregnant, are taking medication, or have concerns about your ability to safely participate in physical activity.

You agree that:

  • You participate in StepSmash activities voluntarily and at your own risk;
  • You are responsible for determining whether any activity is safe and appropriate for you;
  • You will stop any activity if you experience pain, dizziness, shortness of breath, discomfort, or any other concerning symptoms;
  • StepSmash does not provide medical advice, diagnosis, treatment, or emergency assistance.

StepSmash is not responsible for injuries, health issues, accidents, property damage, or other harm that may result from your physical activity, your use of the Service, your reliance on activity goals, or your participation in challenges.

5. Tracker and Health Data Integrations

StepSmash may allow you to connect supported third-party health, fitness, or activity services and devices, such as activity trackers, mobile health platforms, or other integrations. These integrations may allow StepSmash to receive activity-related data such as steps, distance, activity minutes, heart-rate-derived activity information, workout information, or similar data, depending on the permissions you grant and the capabilities of the connected service.

You are responsible for reviewing and managing the permissions you grant through your device, operating system, app store, or third-party service. You may be able to disconnect integrations or revoke permissions through StepSmash, your device settings, or the third-party service.

Third-party services are not operated by StepSmash. We do not control their availability, data accuracy, policies, permissions, outages, limitations, or changes. StepSmash is not responsible for third-party services, devices, APIs, data delays, missing data, inaccurate data, changes to third-party features, or discontinued integrations.

6. Activity Data Accuracy

StepSmash uses activity data from connected services and devices to power games, challenges, progress calculations, leaderboards, and other features. Activity data may be delayed, incomplete, inaccurate, duplicated, corrected later, or unavailable for reasons outside our control.

StepSmash may use algorithms, estimates, normalization methods, baselines, or derived calculations to support fair gameplay across users, devices, and tracker ecosystems. These calculations may not perfectly match what you see in a third-party app or device.

You acknowledge that:

  • StepSmash may not match third-party tracker totals exactly;
  • Activity data can sync late or fail to sync;
  • Device differences may affect how activity is measured;
  • Game results, challenge progress, tile goals, rankings, rewards, and badges may depend on data received from third-party services;
  • StepSmash may correct, adjust, remove, recalculate, or decline to backfill activity data, game results, badges, rankings, or rewards when we believe data is inaccurate, abusive, delayed, duplicated, corrupted, or otherwise unreliable.

7. Games, Challenges, Rankings, and Results

StepSmash provides activity-based games, challenges, progress tracking, leaderboards, badges, streaks, and other features. These features are intended for entertainment and motivation.

We may modify, rebalance, pause, retire, reset, cancel, or change any game mode, challenge, leaderboard, badge, streak, reward, scoring method, difficulty calculation, or related feature at any time.

We may also make decisions about challenge results, ranking corrections, suspicious activity, sync issues, scoring anomalies, or fairness adjustments at our discretion. Our decisions are final unless we choose to review them.

No StepSmash game, challenge, badge, streak, ranking, or achievement has monetary value unless we explicitly state otherwise in separate written terms.

8. Fair Play and Prohibited Conduct

StepSmash depends on friendly, fair competition. You agree not to cheat, manipulate, abuse, disrupt, or misuse the Service.

You may not:

  • Falsify, manipulate, fabricate, or artificially inflate activity data;
  • Use bots, scripts, emulators, automation, modified apps, unauthorized clients, or other tools to interfere with gameplay or the Service;
  • Tamper with tracker data, device data, sync systems, APIs, or game results;
  • Exploit bugs, vulnerabilities, scoring issues, sync delays, or other technical issues;
  • Attempt to reverse engineer, scrape, crawl, copy, or extract data from the Service except as permitted by law;
  • Interfere with the operation, security, or availability of the Service;
  • Harass, threaten, abuse, impersonate, defraud, or harm other users;
  • Upload, post, send, or share unlawful, harmful, hateful, abusive, sexually explicit, violent, defamatory, misleading, infringing, or otherwise objectionable content;
  • Use the Service for spam, scams, phishing, unauthorized advertising, or other commercial solicitation;
  • Violate any applicable law or third-party right.

We may remove content, adjust results, restrict features, suspend accounts, terminate accounts, or take other action if we believe this section has been violated.

9. Community Features and User Content

StepSmash may include social features, in-game chat, profiles, forums, feeds, comments, messages, usernames, avatars, group names, and other features that allow users to submit or share content (“User Content”).

Your use of StepSmash community features is also governed by our Community Guidelines, available at https://community.stepsmash.com/t/faq-guidelines/4. The Community Guidelines are incorporated into these Terms by reference.

You agree to follow those guidelines whenever you use StepSmash community or social features. We may update the Community Guidelines from time to time to reflect new features, safety needs, or community standards.

If we believe you have violated these Terms, our Community Guidelines, or the spirit of fair and respectful participation in StepSmash, we may remove content, restrict access to features, suspend or terminate your account, remove you from games or communities, adjust game results, or take other appropriate action at our discretion.

You are solely responsible for your User Content and for your interactions with other users. You represent and warrant that you have all necessary rights to submit your User Content and that your User Content does not violate these Terms, applicable law, or any third-party rights.

By submitting User Content to StepSmash, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, perform, distribute, adapt, and otherwise use your User Content as needed to operate, provide, improve, promote, and protect the Service.

You retain any ownership rights you have in your User Content. This license ends when your User Content is deleted from the Service, except to the extent it has been shared with others, included in backups, used for safety or enforcement purposes, or otherwise retained as permitted by law or our Privacy Policy.

We may review, moderate, remove, restrict, or refuse to display User Content at our discretion, but we are not obligated to monitor all User Content.

10. Subscriptions, Paid Features, and App Store Billing

StepSmash may offer optional paid subscriptions, paid features, trials, promotions, or other purchases. Paid features may provide access to additional functionality, game creation tools, premium features, or other benefits described at the time of purchase.

Purchases made through the Apple App Store, Google Play Store, or another app store are processed by that app store or platform provider. StepSmash does not directly collect or process your payment card information for those purchases.

Your purchase may be subject to the app store’s own terms, billing rules, refund policies, cancellation process, taxes, regional pricing, currency conversion, renewal rules, grace periods, and payment methods. You should review the applicable app store terms before making a purchase.

Subscriptions may automatically renew unless canceled according to the rules of the platform where you purchased the subscription. Deleting the StepSmash app or deleting your StepSmash account may not cancel your subscription. You must cancel through the applicable app store subscription settings unless we provide another cancellation method for a particular purchase.

We may change subscription pricing, paid features, trial availability, subscription benefits, or promotional offers from time to time. Changes will apply as permitted by the applicable platform and law.

11. Trials, Promotions, and Offers

StepSmash may offer free trials, discounted pricing, promotional access, or other offers. Eligibility, duration, availability, and terms may vary by user, region, platform, subscription type, or promotion.

Unless otherwise stated, trial subscriptions may convert to paid subscriptions at the end of the trial period unless canceled before the trial ends through the applicable app store or platform.

We may modify, limit, or end trials, promotions, or offers at any time, subject to applicable law and platform rules.

12. Refunds

For purchases made through the Apple App Store or Google Play Store, refund requests are generally handled by Apple or Google under their respective policies. StepSmash may not be able to issue refunds directly for app store purchases.

We may, at our discretion and where technically available, provide account credits, promotional access, subscription extensions, or other make-good remedies, but we are not obligated to do so unless required by law.

13. Availability and Changes to the Service

We work to keep StepSmash reliable, but the Service may be unavailable, interrupted, delayed, limited, or affected by bugs, maintenance, outages, data provider issues, app store review delays, third-party service failures, network conditions, or other causes.

We may modify, suspend, discontinue, replace, remove, or limit any part of the Service at any time, including features, game modes, integrations, subscriptions, community features, or supported platforms.

We are not liable for any loss, inconvenience, data issue, missed challenge, ranking change, badge issue, subscription inconvenience, or other harm resulting from Service changes, interruptions, delays, outages, or discontinued features, except where prohibited by law.

14. Software Updates

We may provide updates, patches, bug fixes, or other changes to the Service. Some updates may be required to continue using the Service. The availability and timing of updates may vary by platform, app store, device, operating system, region, or release process.

We may also deliver server-side or over-the-air updates that modify functionality without requiring an app store update.

15. Intellectual Property

The Service, including the StepSmash name, logos, designs, software, code, artwork, visual elements, text, features, game mechanics, interfaces, trademarks, service marks, and other materials, is owned by Rescuebase, our licensors, or our partners and is protected by intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, create derivative works from, publicly display, publicly perform, or otherwise exploit any part of the Service.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

16. Feedback

If you provide feedback, ideas, suggestions, bug reports, feature requests, or other input about StepSmash, you grant us the right to use that feedback without restriction, compensation, or obligation to you. We may use feedback to improve, modify, market, or develop the Service.

17. Privacy

Our collection, use, and sharing of information is described in our Privacy Policy. By using the Service, you acknowledge that you have reviewed our Privacy Policy.

Because StepSmash may process activity, wellness, or tracker-related data depending on the permissions you grant, you should review the Privacy Policy carefully and manage your permissions through the app, your device, and connected third-party services.

The Service may integrate with or link to third-party services, websites, platforms, devices, app stores, community tools, analytics providers, support tools, or other services. These third parties are governed by their own terms and privacy policies.

We are not responsible for third-party services, content, products, policies, outages, security, accuracy, or practices. Your use of third-party services is at your own risk.

19. Account Suspension and Termination

You may stop using StepSmash at any time. You may also be able to delete your account through the Service or by contacting us.

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe:

  • You violated these Terms;
  • You violated our Community Guidelines;
  • Your activity creates risk for StepSmash, other users, third parties, or the Service;
  • Your account has been compromised;
  • You are abusing, cheating, disrupting, or misusing the Service;
  • We are required to do so by law, platform rules, or third-party requirements;
  • Continuing to provide access is no longer commercially or technically feasible.

Termination may result in loss of access to your account, challenges, progress, badges, streaks, rankings, User Content, subscription features, or other data. Termination of your StepSmash account may not automatically cancel app store subscriptions. You remain responsible for canceling subscriptions through the applicable app store.

20. Disclaimers

To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, and error-free operation.

We do not warrant that:

  • The Service will be uninterrupted, secure, accurate, complete, or error-free;
  • Activity data, rankings, badges, streaks, or challenge results will always be accurate;
  • Third-party integrations will remain available or function as expected;
  • The Service will meet your expectations or achieve any fitness, health, motivational, social, or other outcome;
  • Bugs, sync issues, outages, or data errors will be corrected by any particular time.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above disclaimers may not apply to you.

21. Limitation of Liability

To the fullest extent permitted by law, Rescuebase, StepSmash, and our owners, officers, employees, contractors, agents, partners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising out of or related to your use of, or inability to use, the Service.

This includes, without limitation, damages or losses related to lost data, lost subscription value, lost use of the Service, service interruptions, activity data errors, tracker sync issues, inaccurate or delayed data, missed challenges, challenge results, rankings, badges, streaks, progress, community features, goodwill, emotional distress, lost profits, lost revenue, or other intangible losses.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of:

  • The amount you paid to StepSmash for the Service in the twelve months before the event giving rise to the claim; or
  • $100.

The limitations in this section apply regardless of the legal theory, whether based on warranty, contract, statute, tort, negligence, strict liability, or otherwise, and even if a remedy fails of its essential purpose.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law. This may include liability for gross negligence, willful misconduct, fraud, intentional misconduct, bodily injury, or violations of certain consumer protection rights, depending on the laws that apply.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.

22. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Rescuebase, StepSmash, and our owners, officers, employees, contractors, agents, partners, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use or misuse of the Service;
  • Your violation of these Terms;
  • Your User Content;
  • Your violation of any law or third-party right;
  • Your interactions with other users;
  • Your physical activity or participation in challenges;
  • Your manipulation, misuse, or submission of activity data.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of those claims.

23. Dispute Resolution

Before filing a legal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. Your notice should include your name, account email, a description of the dispute, and the relief you are seeking.

We will attempt to resolve the dispute informally within 30 days after receiving your notice. If the dispute is not resolved during that period, either party may pursue available remedies as permitted by these Terms and applicable law.

24. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles, except to the extent local law requires otherwise.

You and StepSmash agree that any dispute not subject to arbitration or small claims court will be brought exclusively in the state or federal courts located in Kent County, Michigan, and you consent to the personal jurisdiction of those courts.

25. International Users

StepSmash may be available in multiple countries or regions. We make no representation that the Service is appropriate or available in every location. You are responsible for complying with the laws that apply to you.

If you access the Service from outside the United States, you acknowledge that your information may be processed in the United States or other countries where we or our service providers operate.

26. App Store Additional Terms

If you download or use StepSmash through the Apple App Store, Google Play Store, or another app store, your use may also be subject to that platform’s terms and policies.

For Apple users, Apple is not responsible for the Service, maintenance, support, claims, or third-party intellectual property issues related to the Service, except as required by applicable Apple terms. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the Service through Apple platforms and may enforce those provisions against you. Apple’s standard end user license agreement for in-app purchases is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

For Google Play users, your use of the Service may also be subject to Google Play’s terms, subscription rules, billing policies, and refund policies. Google Play’s terms of service are available at https://play.google.com/about/play-terms/.

27. Changes to These Terms

We may update these Terms from time to time. When we make changes, we may update the effective date above and provide notice through the Service, website, email, app store release notes, or other reasonable means.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

28. Miscellaneous

These Terms, together with any policies or terms referenced in them, make up the entire agreement between you and StepSmash regarding the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

You may not assign or transfer these Terms or your rights under them without our consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, operation of law, or other business transaction.

Sections that by their nature should survive termination will survive, including sections related to intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and miscellaneous provisions.
